Can constitutionalism deliver on its promises, or has it been asked to do too much? In Constitutionalism and its Discontents, Professor Mark Tushnet (Harvard) and Professor Bojan Bugarič (Sheffield) examine mounting critiques of modern constitutionalism, from the power of courts to democratic backsliding. They argue that efforts to fix these problems through constitutional design often risk making them worse. In response, they advance a “thin” vision of constitutionalism and point to political mobilization beyond the constitutional frame.
In this book discussion, the UNSW Gilbert + Tobin Centre of Public Law, as part of the Greater Sydney Public Law Book Series, hosts Professors Tushnet and Bugarič, in conversation with Anthony Mason and Scientia Professor Rosalind Dixon (UNSW).
